The council business that was supposed to be dissolved

Heart of Cumbria Ltd is a commercial business financed by Eden Council with public money that the council voted to dissolve yet is still trading and taking on new loans and assets.

At a meeting of Eden Council held on the 25th of February 2021

Eden councillors voted in favour of Heart of Cumbria Limited being dissolved and its assets and functions being brought into council control.

On the 26th February 2021 the councils interim director of corporate services, said in a statement to the press “We are looking to close the company in this financial year and we will be putting resources in place to manage and maintain the properties, both that we have now and as they are continued to be built.”

The Eden council financial year ended on 31st March 2021 yet the Heart of Cumbria Ltd is still operating and on the 15th June 2021 signed a new loan agreement with Eden council for further funding and also took ownership of more assets in the form of property at Carlton Meadows Penrith.

The company currently has 2 directors listed with companies house neither elected councillors both directors are listed as Local Government Officer.

The loan and charge registered with Companies house is the 9th loan and charge between Eden council and the Heart of Cumbria lined to property purchase with 0 charges satisfied at this time listed with companies house.

Given Eden council resolved at full council to dissolve the company and take assets back into the direct control of the council and the elected memebrs who were directors and in place ot oversea the running of the business using public money were removed and this resulted in on councillor resigning over the whole action of the move to dissolve the business.

Just why is the business still operating and taking on new assets and loans now more 6 months after council agreed to dissolve the business and now also in a new financial year.

What is the council oversight on this business now and the public money that is invested in the assets enabling the business to operate?

There have been no further resolutions passed in regards Heart of Cumbria business by Eden council that are public record and normally a council resolution can not be overturned within 6 months the last resolution on the same issue.

So the question is do the leadership of Eden council have any control over the business and the public money invested in the business and what is the planned return of the assets and money to the council given the resolution to dissolve the business passed on the 25th of February 2021?
